A trademark is a unique symbol or mark that distinguishes one product from the other. For ease of understanding, it can be compared to a birthmark that is unique to a person. To ensure that the trademark is unique and exclusive, the proprietor must register it as per the conditions laid down by Trademark Act and Rules.
The application form used to serve trademark rectification or cancellation must be filed in prescribed form. The application must include the statement of case, and submit along with the prescribed fee. Further, the application can be submitted to the Registrar or IPAB.
(1) Continuous renewal of the trademark registration.
(2) Doing everything to preserve the distinctive character of the mark and not allowing becoming deceptive.
(3) Continuous use of the mark, as non –continuous use for 5 years may put in rejection category.
(4) As soon as any infringement is observed, take necessary legal action against it and restrain others from doing it.
